Because of the severity of the sanctions for even a first DWI conviction, which will usually involve suspension of your driver's license, a substantial fine and a sharp increase in your insurance premiums, we look at all the circumstances of your arrest to see how we can reduce or defeat the charges.
In some cases, we can successfully challenge the traffic stop that eventually became a DWI arrest, and thus achieve dismissal of the case. In other situations, we can present a challenge to the technical evidence of intoxication based on the blood alcohol test itself. In close cases where a truck driver's blood alcohol reading is .05 percent, or an underage student's reading is .03 percent, our ability to challenge this evidence at trial by itself can achieve a dismissal. Even in cases where the state seeks to prove extreme intoxication at a blood alcohol level greater than .15 percent, forensic review of the evidence can lead to a plea bargain to a lesser charge with far less serious sanctions.
We can also advise you about chemical dependency assessment and treatment programs or obtaining a limited driver's license so that you can drive to work during a period of suspension.
